Advertisers are required to read and accept these terms and conditions before placing an listing and by accepting, you agree to be bound by and to comply with these terms and conditions We reserve the right to change these terms and conditions from time to time without notice.
Content of Advertisement
The Advertiser agrees that it is solely responsible for ensuring that:
- no material provided by the Advertiser will infringe any third party's copyright or other intellectual property rights or otherwise contain or refer to any misleading, deceptive or fraudulent statements or offers;
- no material provided by the Advertiser will be threatening, obscene, offensive, defamatory or in any way unsuitable for people under the age of eighteen (18) years;
- all material provided by the Advertiser will comply with all legal requirements (including laws, codes of conduct, industry codes and standards of practice) applicable to the advertisement.
The Advertiser acknowledges and agrees that Truckworld.com.au Pty Ltd will have absolute editorial control in relation to the advertisements, including position and placement of the advertisement.
Ownership and Use of Advertisements
You hereby assign to Truckworld.com.au Pty Ltd all intellectual property rights in the advertisement and you agree that Truckworld.com.au Pty Ltd has an unfettered right to use (in any way it sees fit) any copyright subsisting in any advertisement you place with Truckworld.com.au Pty Ltd. It is your responsibility to procure necessary moral rights consents from authors of work you submit to us with an listing to enable us to use this work as stated in this section.
Truckworld.com.au Pty Ltd makes no guarantees or representations regarding placement of your advertisement or the content of advertisements grouped with your advertisement and Truckworld.com.au Pty Ltd will not be bound to publish any advertisement submitted by you until it accepts your order.
Truckworld.com.au Pty Ltd may publish or procure the publication of your advertisement on more than one website and within other media as deemed appropriate by and with the absolute discretion of Truckworld.com.au Pty Ltd.
Truckworld.com.au Pty Ltd reserves the right to not to publish any advertisement if in Truckworld.com.au Pty Ltd's absolute discretion:
- the Advertiser is in breach of any term of this agreement; and/or
- the publication of the advertisement is not in the interest of a site or the TC publication.
- the advertisement contains a 'link' to another website.
Exclusion of Warranty
Truckworld.com.au Pty Ltd makes no warranty, promise or guarantee of continuous, uninterrupted access to our services and to this website. Truckworld.com.au Pty Ltd provides this service "as is" and without any warranty or condition, express or implied.
Truckworld.com.au Pty Ltd expressly excludes (to the fullest extent permitted at law):
- all warranties of any kind, including, without limitation, any implied warranties as to fitness of purpose or merchantability of this service or that using this service will not result in infringement of third party rights (including, but not limited to, intellectual property rights)
- all warranties that the services provided by us, including this website, will be timely, secure or error free
Payment
You agree to the advertising fee specified by Truckworld.com.au Pty Ltd in Australian dollars and you remain liable to pay that advertising fee where the advertisement is not published due to a breach of this agreement by you or the advertisement is not published due to your failure to provide sufficient information to us.
Limitation of Liability
Truckworld.com.au Pty Ltd will not be liable for any lost profit or any direct, indirect, punitive, incidental, special or consequential damages (including but not limited to economic damages) which may be suffered or incurred by you as a result of any negligent act or omission by us or arising out of or otherwise in connection with use of this website or our services. Truckworld.com.au Pty Ltd's liability to you is limited to the re-supply of services supplied or offered by us or the cost of this re-supply.
Indemnity
The Advertiser releases and indemnifies Truckworld.com.au Pty Ltd, its employees and agents against all actions, claims and demands (including the cost of defending or settling any actions, claims and demands) which may be instituted against Truckworld.com.au Pty Ltd arising out of any breach of this agreement by the Advertiser, any wilful, unlawful or negligent act by the Advertiser or the publication by Truckworld.com.au Pty Ltd of the advertisement or any material supplied by the Advertiser.
No Partnership
You agree that no joint venture, partnership, employment, or agency relationship exists between you and Truckworld.com.au Pty Ltd as a result of this agreement or use of this website.
Governing Law
This site is operated from the State of New South Wales, Australia. These terms and conditions (and your use of this website) are governed by the law
